The terms “we”, “us” and “our” refer to Farmstead Meats Pty Ltd. Farmstead Meats operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”).
These Terms of Service (“Terms”) describe your rights and responsibilities when you use the Services.
By visiting or purchasing from our website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Services.
SECTION 1 - ACCESS AND ACCOUNT
You must be at least 18 years old to use our Services or purchase products. When you create an account or make a purchase, you agree that all information you provide is accurate, current and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
SECTION 2 - OUR PRODUCTS & PERISHABLE GOODS
We take great care to represent our products accurately. However, natural variations in size, colour and appearance may occur. Product images are illustrative only.
We may, without notice, limit or discontinue any product or adjust product descriptions and pricing at any time. All products available on the Site are subject to availability. Due to market conditions outside our control, including seasonal supply, weather events, or supplier constraints, we may need to substitute certain products in your order.
Where substitutions are required, we will always aim to replace products with other items of similar type, quality, and value. Substitutions do not constitute a fault or failure under these Terms.
Our goods are perishable food items, and:

We recommend refrigerating or freezing products immediately upon delivery.

Once products have been delivered in accordance with your instructions, you are responsible for proper storage and handling.

We are not liable for spoilage, contamination or quality issues resulting from improper storage after delivery.
- Allergen notice: Products may contain or come into contact with common allergens such as nuts, dairy, gluten, sesame, soy, eggs, and shellfish. Always read the packaging and handle it accordingly.
SECTION 3 - ORDERS
When you place an order, you make an offer to purchase products subject to these Terms. We reserve the right to accept or decline any order at our discretion. Orders are only accepted once payment has been received and processed.
You are responsible for reviewing your order carefully before submitting it. Once an order has been placed, it cannot be cancelled or amended by you. We reserve the right, at our sole discretion, to accept, refuse, or cancel any order (in whole or in part) for any reason, including where a product is unavailable, an error in pricing or product information has occurred, or we suspect fraudulent or unauthorised activity.
- Purchases are for personal and household use only, not for resale, export or commercial use.
SECTION 4 - PRICES, TAXES AND BILLING
All prices are displayed in Australian dollars (AUD).
Prices, discounts and promotions may change without notice. The price charged is the one in effect at checkout.

Shipping and handling fees are additional and displayed at checkout.

Promotional codes must be entered at checkout, are non-transferable, cannot be redeemed for cash, and may not be combined with other offers.

SECTION 5 - SHIPPING & DELIVERY
We deliver perishable goods using cold-chain or temperature-controlled logistics partners to ensure freshness and quality.
Delivery windows are estimates only and may vary based on location, weather conditions, traffic, or courier delays.
Delivery Notifications:
You will receive multiple text message updates from our delivery partner, including estimated delivery times, progress notifications, and confirmation once your order has been delivered. A photo proof of delivery will be provided when available.
Authority to Leave (ATL):
If you provide ATL, or if our courier determines it is safe to do so, your order may be left unattended at your delivery address. A photo proof of delivery may be captured for verification. Once delivery occurs at your nominated address (including ATL), risk in the products passes to you.
Missed Deliveries:
If delivery cannot be completed due to incorrect or incomplete details, unsafe access, or no safe place to leave the parcel, we may charge a redelivery fee or, at our discretion, refund your order minus shipping and handling costs.
Storage Responsibility:
You are responsible for collecting and refrigerating your order promptly after delivery. Farmstead Meats is not liable for any loss, spoilage, or damage once delivery has been completed according to your instructions or confirmed by our courier partner.
SECTION 6 - RETURNS, REFUNDS & QUALITY CLAIMS
Due to the perishable nature of our products, we do not accept returns or provide refunds for change of mind.
If your order is damaged, missing items, or not of acceptable quality, please contact us within 24 hours of delivery. Include your order number, description of the issue, and clear photos of the product and packaging.
Where your claim is validated under the Australian Consumer Law, we will, at our option:

refund the affected items,

replace them in your next order, or
-
provide store credit for the value of the affected goods.
We may request the disposal or return of the affected goods for investigation at our expense.
SECTION 7 - AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (ACL).
Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure. You are also entitled to have the goods replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
SECTION 8 - INTELLECTUAL PROPERTY
All content on our website and associated digital channels, including text, graphics, trademarks, and photos, are owned by Farmstead Meats or our licensors. You may use this content only for personal, non-commercial purposes. You may not reproduce, distribute, or exploit our materials without written permission.
SECTION 9 - PRIVACY
All personal information is handled according to our Privacy Policy and Shopify’s Privacy Policy.
SECTION 10 - MOBILE
The Farmstead Meats mobile message service (the "Service") is operated by Farmstead Meats (“Farmstead Meats”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Farmstead Meats’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Farmstead Meats through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Farmstead Meats. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to Farmstead or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Farmstead Meats mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
SECTION 11 - FORCE MAJEURE
We are not liable for delays or failures to perform due to causes beyond our reasonable control, including extreme weather, natural disasters, strikes, transport disruptions, or government restrictions.
SECTION 12 - LIMITATION OF LIABILITY
To the fullest extent permitted by law:

Our total liability for any claim arising out of your purchase is limited to the amount paid for the relevant products.

SECTION 13 - GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
